- OBJECT
These general terms and conditions of sale (hereinafter "GTC") aim to define the conditions under which sales of products offered by the company Joli Lab, 2 quai Gillet 69004 Lyon (hereinafter "Joli Lab") are made via its online store jolilab.fr (hereinafter "the Site"). They apply exclusively between the company Joli Lab and any individual consumer (hereinafter "the Customer") wishing to make a purchase on the Site.
Any order placed with Joli Lab entails the unreserved acceptance by the Customer of these conditions. These T&Cs may be modified at any time and without notice by Joli Lab. However, the applicable conditions will be those in force on the date of the order by the Customer.
- PRODUCTS
The Products governed by these General Terms and Conditions are those appearing on the Site. They are offered within the limits of available stocks.
The Products are described and presented with the greatest possible accuracy. However, in the event of an error or omission regarding this presentation, Joli Lab cannot be held liable. The photographs of the Products are not contractual unless otherwise stated.
- CUSTOMER OBLIGATIONS
The Customer declares to be at least 18 years old and to have the legal capacity or to hold parental authorization allowing him to place an order on the Site. The Customer undertakes to communicate to Joli Lab valid information necessary for the proper receipt of his order.
Joli Lab cannot be held responsible for the transmission of false or inaccurate information.
- REGISTRATION AND VALIDATION OF THE ORDER
An order is only validated after acceptance of payment.
Once your order has been validated, Joli Lab will send you a confirmation email summarizing your entire order (nature of products ordered, quantity and price).
Joli Lab reserves the right to cancel or refuse an order in the event of a dispute with the Customer over a previous order, non-payment, or incorrect address.
All orders placed on the Site are intended for the personal use of Customers who are prohibited from any partial or total resale of the Products.
In the event of unavailability of an ordered Product, the Customer will be informed by email. The cancellation of the order for this Product and its possible refund or exchange will be offered to the Customer.
- PRICE
The prices displayed on the Site are indicated in euros, all French taxes included (French VAT and other taxes that may be applicable), excluding shipping costs, participation in order processing costs and packaging costs. Shipping costs, participation in order processing costs and packaging costs will be indicated in the Customer's shopping cart, before the final validation of the order. Prices may be modified at any time, without notice and in particular in the event of a change in tax or economic data. The items will be invoiced on the basis of the rates in effect at the time the order is registered.
- DELIVERY AND RETURNS
Non-personalized and non-monthly box items are generally shipped within 2 to 5 business days after receipt of payment (except for stock shortages, holidays or force majeure). The delay can be up to 7 business days for personalized items. If your order includes several items with different delivery times, take into account the longest shipping time.
Your orders are shipped by registered letter or Colissimo, delivered without signature depending on the volume and weight of your order. Regardless of the shipping method, Joli Lab undertakes to provide the Customer as soon as possible with a link that will allow them to track the delivery of their order online.
From the time of collection by La Poste, you will be delivered to your home in 2 to 3 working days if you live in mainland France, 2 to 4 working days if you live in another country included in our delivery zone.
Any delays do not entitle the Customer to claim damages. War, riots, fire, social unrest, accidents and the impossibility of obtaining supplies are considered cases of force majeure releasing the seller from his obligation to deliver.
Goods always travel at the recipient's risk.
If the Buyer wants 2 delivery locations, he will have to register 2 separate orders.
6.2. REIMBURSEMENT
All Products delivered to Metropolitan France may be subject to a refund except for personalized Products.
Returned Products must be intact, complete, packaged in their original packaging. They must not have been worn and/or damaged in any way.
The Buyer's wish to be reimbursed must be communicated by email to jolilablyon@gmail.com.
The Buyer has a right of withdrawal of fourteen (14) calendar days from the date of receipt. During this period, the Buyer may return the Products to the address below, without having to justify the reason or pay a penalty. The Buyer may return the Products by La Poste by registered letter or by Colissimo Suivi. The Buyer must imperatively communicate the tracking number of the package as soon as possible by email to the address contact@jolilab.fr
The return costs via La Poste are the sole responsibility of the Buyer, with the exception of a Product that is defective upon receipt, or an error when sending the Product.
Joli Lab will reimburse the buyer for the returned Products only (shipping costs remain the responsibility of the Buyer), subject to compliance with the conditions mentioned above. The refund will be made via the means of payment of the returned order or by check if this proves impossible.
6.3. EXCHANGE
The Customer also has a period of fourteen (14) days to request an exchange. He will then not have to pay delivery costs on the new exchange order. The Customer can return the Products to Joli Lab by La Poste (same procedure as for the refund cf 5.1). As a reminder, the return costs by La Poste remain the responsibility of the Customer and the Products to be returned must be intact, complete, packaged in the original packaging.
- PAYMENT
Full payment must be made when ordering. The Customer pays for their order by credit card (Visa, Eurocard/Mastercard) or with their Paypal account. No payment by check will be accepted.
The communication by the Customer of his bank card number constitutes authorization for Joli Lab to debit his account up to the amount of his order.
Joli Lab retains ownership of the item until full payment of the price by the Customer. Purchases are made securely. For credit card payments, the information that Customers communicate to Joli Lab is strictly protected and guarantees the compliance and security of each transaction.
- WARRANTIES AND LIABILITY
Joli Lab has only an obligation of means. Its liability cannot be incurred for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with the law and case law.
- INTELLECTUAL PROPERTY
All elements of the Site are the exclusive property of the company Joli Lab. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site without authorization.
- CONFIDENTIALITY
Joli Lab undertakes to use the confidential information of Customers only within the framework of the operation of its Site.
For the smooth running of the order, the personal data collected will be subject to computer processing, the Customer acknowledges being aware of this.
In accordance with the law of January 6, 1978 amended by the law of August 6, 2004, the Client has a right to access and rectify personal data concerning him/her contained in Joli Lab's files. Any request must be sent by e-mail to jolilablyon@gmail.com.
