- SUBJECT
The present general terms and conditions of sale (hereafter "GTC") are intended to define the conditions under which sales of products offered by the company Joli Lab, 2 quai Gillet 69004 Lyon (hereafter " Joli Lab ") are made via its online store jolilab.fr (hereafter "the Site"). They apply exclusively between the company Joli Lab and any individual consumer (hereinafter "the Customer") wishing to make a purchase on the Site.
Any order placed with de Joli Lab implies the Customer's unreserved acceptance of these terms and conditions. These GCS may be modified at any time and without notice by Joli Lab, However, the applicable conditions will be those in force at the date of the order by the Customer.
- PRODUCTS
The Products governed by these GCS are those appearing on the Site. They are offered within the limits of available stocks.
The Products are described and presented as accurately as possible. However, in the event of any error or omission as concerns such presentation, the Company Joli Lab shall not be held liable. The photographs of the Products are not contractual unless otherwise specified.
- CONSUMER OBLIGATIONS
The Customer declares to be at least 18 years old and to have the legal capacity or to be holder of a parental authorization allowing him to make an order on the Site. The Customer undertakes to provide Joli Lab valid information necessary for the proper receipt of his order.
Joli Lab cannot be held responsible for the transmission of false or inaccurate information.
- REGISTRATION AND VALIDATION OF THE ORDER
An order is validated only after acceptance of payment.
As soon as your order has been validated, Joli Lab you will receive a confirmation e-mail summarising the entirety of your order (nature of the products ordered, quantity and price).
Joli Lab reserves the right to cancel or refuse an order in the event of a dispute with the Customer over a previous order, default of payment, or incorrect address.
All orders placed on the Site are intended for the personal use of the Customers, who are prohibited from reselling the Products in whole or in part.
In case of unavailability of a Product ordered, the Customer will be informed by e-mail. The cancellation of the order of this Product and its possible refund or exchange will be proposed to the Customer.
- PRIZE
The prices displayed on the Site are indicated in euros, including all French taxes (French VAT and other taxes that may be applicable), excluding shipping costs, participation in order processing costs and packaging costs. The shipping costs, participation in the costs of order processing and packaging costs will be indicated in the Customer's basket, before the final validation of the order. Prices may be modified at any time, without prior notice and in particular in the event of a change in fiscal or economic data. Items will be invoiced on the basis of the rates in force at the time the order is recorded.
- DELIVERY AND RETURNS
Non-personalized items and out of the monthly box are generally shipped within 2 to 5 working days after receipt of payment (except out of stock, holidays or force majeure). The delay can be up to 7 working days for personalized items. If your order includes several items with different delivery times, please take into account the longest shipping time.
Your orders are shipped by lettre Suivie or Colissimo, delivered without signature depending on the volume and weight of your order. Whatever the method of shipment, Joli Lab undertakes to provide the Customer as soon as possible a link that will allow him to track online delivery of his order.
From the moment you are picked up by La Poste, you are delivered to your home in 2 to 3 working days if you live in metropolitan France, 2 to 4 working days if you live in another country included in our delivery zone.
Possible delays do not entitle the Customer to claim damages. War, riots, riots, fire, industrial action, accidents and the impossibility of being supplied are considered as cases of force majeure discharging the seller from its obligation to deliver.
Goods always travel at the risk of the recipient.
If the Buyer wishes 2 places of delivery, he will have to register 2 separate orders.
6.2. REIMBURSEMENT
All Products delivered in Metropolitan France can be the subject of a refund with the exception of personalized Products.
Returned Products must be intact, complete and in their original packaging. Under no circumstances must they have been worn and/or damaged.
The Purchaser's wish to be reimbursed must be communicated by e-mail to [email protected].
L'Acheteur dispose d'un droit de rétractation de quatorze (14) jours calendaires à compter de la date de réception. Pendant ce délai, l'Acheteur pourra retourner les Produits à l'adresse ci-après, sans avoir à en justifier le motif, ni à payer de pénalité. L'Acheteur pourra retourner les Produits par La Poste en Lettre suivie ou en Colissimo Suivi. Il devra impérativement communiquer le numéro de suivi du colis dans les plus brefs délais par mail à l'adresse [email protected]
The costs of return via La Poste are at the sole charge of the Buyer with the exception of a defective Product upon receipt, or an error in sending the Product.
Joli Lab will reimburse the Buyer for returned Products only (shipping costs remain at the Buyer's expense), subject to compliance with the above-mentioned conditions. Reimbursement will be made via the means of payment of the returned order or by cheque if this proves impossible.
6.3. EXCHANGE
The Customer also has a period of fourteen (14) days to request an exchange. He will then not have to pay any delivery charges on the new exchange order. The Customer can return the Products to Joli Lab par La Poste (same procedure as for the refund cf 5.1). As a reminder, the costs of return by La Poste remain at the expense of the Customer and the Products to be returned must be intact, complete, packed in the original packaging.
- PAYMENT
Full payment must be made at the time of ordering. The Customer pays for his order by credit card (Visa, Eurocard/Mastercard) or with his Paypal account. No payment by cheque will be accepted.
The communication by the Customer of his credit card number is equivalent to authorization to debit his account up to the amount of his order.Joli Lab
Joli Lab retains ownership of the item until full payment of the price by the Customer. Purchases are made in a secure manner. For credit card payments, the information that Customers communicate to Joli Lab is strictly protected and guarantees the conformity and security of each transaction.
- WARRANTIES AND LIABILITY
The company Joli Lab has only an obligation of means. Its liability cannot be engaged for any inconvenience or damage inherent to the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or for any fact qualified as force majeure, in accordance with the law and jurisprudence.
- COPYRIGHT PROTECTION
All the elements of the Site are the exclusive property of the companyJoli Lab. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site without authorization.
- CONFIDENTIALITY
Joli Lab undertakes to use the confidential information of the Customers only within the framework of the operation of its Site.
For the proper processing of the order, the personal data collected will be subject to computer processing, the Customer acknowledges having knowledge of it.
In accordance with the law of January 6, 1978, modified by the law of August 6, 2004, the customer has the right to access and rectify personal data concerning him/her contained in Joli Lab files. All requests should be sent by e-mail to [email protected].
